Well, the Kinux kernel is free software under GPL version 2. There is nothing stopping Poetering from forking it.
Exccept for the cost of maintanance and updating for new hardware.
But Linus seems to have disdain for Poetterings attempts to contribute to the kernel in the past; this will likely continue, so P.'s changes will likely not move to the official Linux kernel.
